Unlawful Detention
Kiely McCarthy LLP have on numerous occasions represented those who have been victim to an unlawful detention. By virtue of the Irish Constitution and the European Convention on Human Rights, everyone has a right to liberty and freedom from arbitrary detention. If a person is wrongfully detained by authorities, or by another individual without legal justification, this is an unlawful detention.
If you have been detained by Gardaí without proper legal grounds, held for an excessive period without charge, or denied legal representation, these are all factors which will constitute an unlawful detention and will entitled you to legal redress.
