Drugs Offences

It is an offence under legislation to have in your possession a controlled drug for personal use and or for sale and/or supply. Other offences, such as allowing your premises to be used for the manufacturing, import or supply of controlled substances are also contained in the legislation.

Any case relating to drugs is considered as a serious offence. If you have no previous convictions and found with a relatively small amount of drugs, it may be possible to avoid a prosecution or to leave court without a criminal conviction. It is important that you get legal advice as soon as possible.

The value of the alleged drugs will determine on whether the case is dealt with in the District Court or the Circuit Court. If the Director of Public Prosecutions decide to send your case forward to the Circuit Court, you will receive a Book of Evidence and at least one Barrister will be briefed to fully consider the case, represent you in Court and to see if the proofs are in order.
