A European Arrest Warrant (‘EAW’) is a cross-border judicial surrender procedure for the purpose of prosecution or execution a custodial sentence or detention order. This is often a surprising occurrence for the defendants and their families owing to the minimal notice given. Where a person consents to his or her surrender, a final decision on the execution of the EAW must occur within 10 days. If consent is not given, the execution of the EAW must occur within 60 days.

Extradition between Ireland and England is now dealt with under the EU-UK Trade and Cooperation Agreement which works under a very similar structure.
